Terms of use for e-commerce tools and coupons by the establishment
“Everything is in Móstoles” is an institutional initiative of the Móstoles City Council aimed at supporting small and medium-sized enterprises (SMEs) in the retail sector that operate within the city's commercial fabric. It is promoted by Móstoles Desarrollo, a division of the Móstoles City Council; therefore, there is no commission or financial benefit for the promoter.
Each business listing has a space enabled to include PDFs, downloadable as bonuses or offers, and to embed your own e-commerce or marketplace platforms.
1. Downloadable PDFs – Bonuses
The voucher creation tool of the Todo Está En Móstoles platform is a technological development that the Móstoles City Council makes available free of charge to establishments affiliated with the web portal, to establish and create marketing campaigns in the form of coupons with different offers of their products.
The coupons offered by each of the participating establishments are designed, created and offered exclusively by each of the establishments that wish to use the technological tool, and have the character of a contractual commercial agreement between the offering business or establishment, and the customer who receives it, without the Móstoles City Council or the company/s managing the platform having any link with the campaign, its results or its economic or legal repercussions.
Therefore, the Móstoles City Council, as well as the company/companies managing the Todo Está En Móstoles web platform, are not responsible for the campaigns created through the technology that provides the service, nor for the products or services offered or acquired.
If the establishment uses this service, once the user has downloaded the voucher from the website www.todoestaenMóstoles.com, they can redeem it directly at the establishment when they go to enjoy it, or when making an appointment (if required), as long as the instructions of the downloadable voucher specify it.
In cases where downloadable items can be redeemed digitally, these will be redeemed on the website of each individual establishment. The terms and delivery times for the product will depend on the establishment.
Each one will specify the dates of the offers to enjoy the voucher at the establishment or to make an appointment (if required).
Likewise, the downloadable materials may not be exchanged, substituted, or traded for their monetary value. Their commercialization, sale, or auction is also prohibited.
The user will have access to the description of each voucher offered by each of the affiliated establishments within the establishment's voucher itself.
2.- e_shop
Each business listing has the option to use the platform to market its products, provided that all financial transactions are carried out outside of the www.todoestaenmóstoles.com website, and it is clearly indicated that the purchase will be made within the store's environment.
3.- Commitment of the parties
3.1.- Commitment as a user
The user is responsible for using the downloadable files or bonuses correctly, as indicated in each situation.
To redeem it properly, you must present the downloaded voucher at the corresponding establishment.
It is the user's responsibility to be informed about the conditions required for each specific case.
3.2.- Commitment as an affiliated establishment
Each participating establishment agrees to provide the user with the benefits described in the voucher, provided that it is done under the terms mentioned above and within the established dates.
Any conflict, claim or incident of any kind that may arise between users and affiliated establishments must be handled directly between the user and the establishment on a case-by-case basis.
The promotions offered in each coupon campaign through the Todo Está En Móstoles voucher platform must comply with the law. Todo Está En Móstoles reserves the right to cancel or suspend a campaign if there are indications or suspicions that it may violate current legislation.
4. Reservations, limitations and liability
The Móstoles City Council is exempt from any responsibility in the event of any error in the data provided by the merchants that prevents the enjoyment of the voucher.
Móstoles City Council reserves the right to exclude, without prior notice, all persons and establishments that make fraudulent use of the data, contrary to good faith, or if there is suspicion of improper manipulation of the data.
The Móstoles City Council reserves the right to take legal action against establishments and/or individuals who carry out any type of act that could be considered manipulation or falsification of this commercial revitalization action.
Likewise, the Móstoles City Council is not responsible for any losses, damages, thefts or any other attributable circumstances that may affect the enjoyment of the voucher.
The Móstoles City Council exempts any liability for damages of any kind that may be due to the temporary lack of availability or continuity of the products promoted and/or offered by the establishments participating in the promotion action, as well as any fraud or misuse that users may have attributed to them.
The Móstoles City Council reserves the right to interpret these terms and conditions, correct or rectify them, and also the right to postpone, temporarily suspend, repeat, cancel the promotion, or extend the activation period of the commercial activity. In any of these cases, the changes will be communicated with sufficient advance notice and publicity for general awareness.
The Móstoles City Council will not be liable for any incidents or damages of any kind that may arise during the management, development, and execution of the promotion. The organizer will also not be responsible for cases of force majeure that may prevent the winners from fully or partially enjoying their prize.
The Móstoles City Council assumes no responsibility for any incident, accident, injury, or any other circumstance that may occur to users while enjoying the prize. Likewise, the promoter does not assume any expenses or amounts other than those indicated, whether related to travel, accommodation, or any other matter. The promoter is also not responsible for interruptions, disconnections, failures, errors, or overload on the internet, on the website hosting the official rules of the promotion, software or hardware failures, bugs, hacker attacks, computer viruses, power outages or overloads, failures or overloads of the promoter's servers or internet providers (wireless or wired), alterations, maintenance, unauthorized interventions, fraud, technical failures, or serious natural phenomena (including, but not limited to, electrical storms, floods, fires, or earthquakes). Similarly, the promoter assumes no responsibility for: (i) any incorrect or inaccurate information provided by the establishment at the time of registration. (ii) any incomplete, failed, garbled, erroneous, or disordered electronic transmission related to the promotion; (ii) any human error, technical failure, omission, interruption, deletion, defect, delay in operations, or communication line failure, regardless of the cause, in connection with any equipment, system, network, line, satellite, server, provider, or computer used in any aspect of the operation of the contest; (iii) inaccessibility or unavailability of the internet or any subsequent combination thereof; (iv) any damage or injury to the user's or any other person's computer, or to any mobile device, that may be related to, or result from, any attempt to participate in the promotional promotion or to download materials related to it.
5.- Legal regime and competent jurisdiction
These Terms and Conditions, as well as any exchange of vouchers made under them, will be subject to the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other applicable regulations.
For any legal disputes that may arise between users and establishments, they submit to the jurisdiction of the civil courts and tribunals of Madrid.
